These Terms and Conditions govern access to and use of the www.fimas.it website (hereinafter, the “Site”). Accessing and browsing the Site implies acceptance of these Terms. If you do not intend to accept them, please do not use the Site.

The Site has informational and promotional purposes relating to the business of Fimas S.r.l. and to its products, in particular slabs in Monostrato Vulcanico dell'Etna (Etna volcanic monolayer paving) for anti-slip outdoor flooring.
The Site is not an e-commerce platform: the content published (including products, formats, colors, thicknesses, images and documentation) is purely informational and does not constitute an offer to the public pursuant to Art. 1336 of the Italian Civil Code, nor a contractual proposal. Any quotations, orders and supplies are defined exclusively through separate direct agreements between Fimas S.r.l. and the customer.

The form on the Contacts page can be used to request information, price lists, specification items and free samples. Submitting a request does not create any contractual obligation for either party. The free sample service is available only within Italy, is subject to availability and is provided at the discretion of Fimas S.r.l. The personal data provided through the form are processed as described in the Privacy Policy.
All the content of the Site — by way of example: texts, photographs, videos, technical drawings, data sheets, documents, graphics, logos and distinctive signs, including the trademark and the name MONOSTRATO VULCANICO DELL'ETNA — is owned by Fimas S.r.l. or by the respective owners and is protected by copyright and industrial property law.
Consultation of the Site for personal and informational use is permitted. Without the prior written authorization of Fimas S.r.l., the reproduction, distribution, modification, publication and any other form of use of the content for the commercial or promotional purposes of third parties is prohibited.
The technical documentation published on the Site (specifications, certifications, product data sheets, installation guidelines and tips) is indicative and not prescriptive: it summarizes practices commonly adopted in the industry and the manufacturer's experience, but it does not replace the design, execution and structural assessments that are the exclusive responsibility of qualified professionals and of the Works Management team.
Fimas S.r.l. is not liable for the design or application choices made by third parties on the basis of the content of the Site, nor for damages arising from improper, partial or incorrect use of such information.
The Site is provided “as is”. Fimas S.r.l. devotes the utmost care to keeping the content updated and accurate, but does not warrant that it is always free of errors, complete or up to date, nor does it warrant the continuous and uninterrupted availability of the Site.
Within the limits permitted by law, Fimas S.r.l. is not liable for direct or indirect damages arising from the use of, or the inability to use, the Site. Nothing in these Terms excludes or limits the liability of Fimas S.r.l. in those cases where it cannot be excluded or limited under the law (including cases of willful misconduct or gross negligence).
The Site may embed services and content provided by third parties — for example the Google Maps map on the Contacts page, the Google Fonts typefaces and the address suggestion service based on OpenStreetMap — and may contain links to external sites. Such services and sites are subject to the terms and privacy notices of their respective operators: Fimas S.r.l. exercises no control over them and is not liable for them. The processing of the personal data of users of the Site is governed by the Privacy Policy, drawn up pursuant to Articles 13 and 14 of Regulation (EU) 2016/679, which forms an integral part of these terms of use. Fimas S.r.l. reserves the right to amend these Terms at any time, including as a result of regulatory developments or of changes to the Site. The version in force, with its update date, is the one published on this page. Use of the Site after the changes have been published constitutes acceptance of them.
These Terms are governed by Italian law. Any dispute concerning the interpretation, performance or breach of these Terms falls under the exclusive jurisdiction of the Court of Catania, without prejudice, for users qualifying as consumers, to the mandatory jurisdiction of the consumer's place of residence or domicile provided for by Italian Legislative Decree 206/2005 (Consumer Code).
